Tennessee courts use a primary residential parent and alternate residential parent framework rather than traditional custody and visitation labels. Parental Relocation

A mother who wants to relocate more than 50 miles from the other parent or move out of state must provide written notice no later than 60 days before the planned move. The other parent may object, which triggers a court hearing. We advise mothers on the notice requirements and represent them through contested relocation proceedings when the other parent challenges the move.

In divorce proceedings, custody is determined under Tennessee Code § 36-6-106, which directs Hamilton County Family Court to decide custody based on the best interest of the child. Courts weigh a range of factors under that standard, and a child aged 12 or older may have their preferences considered, though the judge retains full discretion over the outcome.
